Welcome to Transform 180. These Terms of Use (“Terms”) govern your access to and use of transform180training.com (the “Site”) and the services described on it, operated by Transform 180, LLC (“Transform 180,” “we,” “us,” or “our”). By accessing or using the Site, booking a tour, purchasing a membership or session package, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.
1. Who We Are
Transform 180, LLC operates personal training, partner training, and 24/7 open-gym facilities in Seattle and the greater Puget Sound area, including our Belltown, South Lake Union, and Madison Park locations. Our registered business address is 300 Fairview Ave N., Seattle, WA 98109.
2. Eligibility
You must be at least 18 years old to create an account, book a tour, or purchase a membership through the Site. If you are between 13 and 17, a parent or legal guardian must review and agree to these Terms on your behalf and accompany you for any in-person services requiring a signed waiver.
3. Memberships, Training Packages & Payments
3.1 Purchasing a membership, open-gym plan, or personal/partner training package (online or in person) constitutes your agreement to the pricing, billing frequency, and terms presented to you at the time of purchase, including any Membership Agreement and Liability Waiver signed separately at enrollment.
3.2 Memberships and recurring training packages are billed automatically on a recurring basis (e.g., monthly) to the payment method on file until cancelled in accordance with your Membership Agreement.
3.3 We reserve the right to change our pricing at any time. Any change will not apply retroactively to a billing period you have already paid for.
3.4 Cancellations, freezes, and refund requests are handled according to the cancellation policy in your signed Membership Agreement. If you have questions about your specific membership terms, contact us at training@transform180.com.
3.5 A “Book a Tour” reservation is a scheduling request only and does not constitute a membership or financial obligation.
4. Facility Access & Conduct
4.1 24/7 access to our open-gym locations is provided via the Kisi access-control app or another access method we designate, and is available only to members in good standing. Sharing access credentials with non-members is prohibited and may result in suspension or termination of your membership.
4.2 While using our facilities, you agree to follow all posted rules, staff instructions, and reasonable safety guidelines. We may deny or revoke access to anyone who violates these Terms, damages equipment, or endangers the safety of others.
5. Assumption of Risk & Health Disclaimer
5.1 Exercise and physical training involve inherent risks, including but not limited to muscle strain, joint injury, cardiovascular events, and, in rare cases, serious injury or death. By using our facilities, equipment, or training services, you acknowledge and voluntarily assume these risks.
5.2 You represent that you are physically fit and have no medical condition that would prevent your safe participation in exercise, or that you have consulted a physician and received clearance to participate. We strongly recommend consulting your physician before beginning any new exercise program, particularly if you are pregnant, elderly, or have a pre-existing health condition.
5.3 This section is a summary only. The full waiver and release of liability applicable to your use of our facilities is set out in the Liability Waiver you sign at enrollment or check-in, which controls in the event of any conflict with this section.
6. Use of the Site
6.1 You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Site by, any third party.
6.2 You agree not to: (a) attempt to gain unauthorized access to any part of the Site or its related systems; (b) use any automated system (including bots or scrapers) to access the Site without our prior written consent; (c) upload or transmit any viruses or malicious code; or (d) impersonate any person or entity.
7. Intellectual Property
All content on the Site — including text, graphics, logos, images, and software — is the property of Transform 180, LLC or its licensors and is protected by U.S. and international copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written permission.
8. Third-Party Links & Services
The Site may contain links to third-party websites or services (such as our Mindbody booking system or payment processors) that are not owned or controlled by Transform 180. We are not responsible for the content, privacy practices, or terms of any third-party site. Your use of any third-party service is subject to that party’s own terms and policies.
9. Disclaimer of Warranties
The Site and all content are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.
10. Limitation of Liability
To the fullest extent permitted by law, Transform 180, LLC and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of the Site or our services, even if we have been advised of the possibility of such damages. Nothing in these Terms is intended to limit liability that cannot be limited under applicable law.
11. Indemnification
You agree to indemnify and hold harmless Transform 180, LLC, its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
12. Governing Law
These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-law principles. Any dispute arising under these Terms shall be brought exclusively in the state or federal courts located in King County, Washington.
13. Changes to These Terms
We may update these Terms from time to time at our discretion. Changes will be posted on this page with an updated “Last updated” date. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.
